1. Eligibility & Account Registration

You may browse our collection and complete purchases either by registering an Octa Pearl member account or through guest checkout. When creating an account, you agree to provide truthful, accurate, and current information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. Product Information & Diamond Certification

• Lab-Grown Diamonds: All center stones in our engagement rings and fine jewelry are genuine laboratory-grown diamonds with the exact physical, chemical, and optical characteristics of earth-mined diamonds.
• Independent Certification: Center stones are accompanied by an independent grading report from the International Gemological Institute (IGI). Each certified stone features a laser-inscribed report number on its girdle matching the physical certificate.
• Precious Metals: All jewelry is crafted in genuine solid gold (10K, 14K, 18K) or 950 Platinum as specified in your order.
• Handcrafted Variations: Because every piece of jewelry is individually handcrafted to order by skilled artisans, slight dimensional or aesthetic variations may naturally occur.

3. Order Placement, Production & Availability

When you place an order, you have the flexibility to select metal karat, metal color (White, Yellow, Rose), ring size, and optional personalized laser engraving.

• Order Acceptance: After placing an order, you will receive an automated order receipt email. Orders are considered finalized and binding once payment authorization is confirmed.
• Made-to-Order Production: The majority of our engagement rings and fine jewelry are handcrafted to order. Standard production and quality inspection require 10 to 14 business days prior to dispatch.
• Availability & Cancellation Rights: In the rare event that materials or stones are unavailable, we will contact you within five (5) business days and issue an immediate full refund. We reserve the right to decline or cancel any order in cases of unauthorized payment, suspected fraud, or pricing errors.

4. Order Cancellations & Modifications (24-Hour Window)

Because bespoke and made-to-order production begins immediately upon payment authorization, cancellations or order modifications (such as ring size or gold color changes) can only be accommodated within 24 hours of order placement. After 24 hours, materials have been allocated and orders cannot be cancelled.

5. Pricing & Payment Processing

All prices displayed on the Site are in US Dollars (USD) unless specified otherwise. We reserve the right to correct any typographical or clerical pricing errors without liability.

We provide industry-standard 256-bit SSL encrypted checkout. We accept the following secure payment methods:

• Major Credit & Debit Cards: Visa, MasterCard, American Express, and Discover.
• Shop Pay: Accelerated checkout and Shop Pay Installments (powered by Affirm).
• Digital Wallets: Apple Pay and Google Pay.

By submitting payment details, you confirm that you are the authorized cardholder or account owner. All transactions are subject to validation and authorization by your financial institution.

6. Shipping, Delivery & Security

• Free Fully Insured US Shipping: We provide complimentary, fully insured shipping across the United States. Following production, delivery takes approximately 5 to 7 business days.
• Signature Required: For your protection and peace of mind, all fine jewelry shipments require a direct adult signature upon delivery. Please inspect package integrity prior to signing.
• International Shipments: International orders may be subject to local customs duties, taxes, or import fees imposed by the destination country, which remain the sole responsibility of the recipient.

7. Returns, Exchanges & Quality Standards

• 30-Day Returns: You may return or exchange eligible jewelry within 30 days of confirmed delivery, including items with complimentary laser engraving, provided they are unworn and in original condition with the IGI certificate. Please refer to our full Refund & Return Policy for complete details.
• Quality Standards: Every Octa Pearl engagement ring and fine jewelry piece is meticulously handcrafted with precision to meet strict gemological standards and includes complimentary ring resizing.

8. Intellectual Property

All trademarks, logos, brand names, product photography, 3D renderings, written copy, and graphic assets on octapearl.com are the exclusive intellectual property of Octa Pearl LLC. Unauthorized reproduction, modification, distribution, or commercial use is strictly prohibited without prior written consent.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Octa Pearl LLC shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of our Site, products, or services. Our total liability for any claim shall not exceed the total amount paid by you for the specific purchase giving rise to the claim.

10. Governing Law & Jurisdiction

These Terms and any separate agreements shall be governed by and construed in accordance with the laws of the State of New York and the federal laws of the United States of America, without regard to conflict of law principles. Any legal proceedings shall be brought exclusively in the state or federal courts located in New York County, New York.
